These Terms and Conditions ("Terms") govern your use of ondermax.com and any purchases made through our website or authorised sales channels.

2. Definitions
In these Terms:
- "We," "Us," "Our" refers to Ondermax LTD.
- "You," "Your" refers to the customer or user of our website.
- "Products" refers to the transdermal patches and health/wellness products offered for sale.
- "Website" refers to ondermax.com and any associated storefront.
- "Order" refers to a request by You to purchase Products from Us.
- "Contract" refers to the legally binding agreement between You and Us formed upon Order acceptance.
- "Working Days" means Monday to Friday, excluding public holidays in England.
3. Order Process and Acceptance
3.1. All Orders placed through our Website constitute an offer by You to purchase Products in accordance with these Terms.
3.2. We will send You an Order confirmation by email. A binding Contract is formed only when We dispatch Your Products or send a dispatch confirmation email, whichever occurs first.
3.3. We reserve the right to refuse or cancel any Order for any reason, including but not limited to product availability, pricing errors, or suspected fraud. If We cancel an Order after payment has been taken, We will issue a full refund.
3.4. It is Your responsibility to ensure that the details provided in Your Order are accurate and complete.
4. Pricing and Payment
4.1. All prices are displayed on the Website and are inclusive of any applicable taxes unless otherwise stated. Prices are quoted in AED, USD, or GBP depending on Your selected currency.
4.2. We reserve the right to change prices at any time. The price applicable to Your Order is the price displayed at the time You place Your Order.
4.3. We accept the following payment methods:
- Credit/Debit Card (via Stripe)
- Wire Transfer / Bank Transfer
- Cash on Delivery (available in selected regions)
4.4. Payment must be received in full before dispatch, except where Cash on Delivery has been agreed.
4.5. If payment by Wire Transfer is selected, Your Order will be processed upon confirmation of cleared funds.
4.6. All card payments are processed securely through Stripe. We do not store Your card details.
5. Delivery and Shipping
5.1. We ship to the United Kingdom, the GCC region (United Arab Emirates, Saudi Arabia, Kuwait, Bahrain, Oman, and Qatar), and selected international destinations.
5.2. Products are dispatched from our fulfilment warehouse in Dubai, UAE, or from other locations as applicable.
5.3. Estimated delivery times are provided at checkout and are indicative only. We shall make reasonable efforts to deliver within the estimated timeframe but cannot guarantee specific delivery dates.
5.4. Typical delivery estimates:
- UAE: 1-3 working days
- GCC Region: 3-7 working days
- United Kingdom: 5-10 working days
- International: 7-21 working days
5.5. Risk of loss or damage to Products passes to You upon delivery.
5.6. If delivery cannot be completed due to incorrect address details provided by You, additional shipping costs may apply.
5.7. For international orders, You are responsible for any customs duties, import taxes, or additional charges levied by Your country's authorities. These charges are not included in our prices.
6. Right of Cancellation
6.1. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, if You are a consumer in the United Kingdom, You have the right to cancel Your Order within 14 days from the day after You receive Your Products (the "Cooling-Off Period"), without giving any reason.
6.2. To exercise Your right of cancellation, You must inform Us of Your decision by a clear statement sent to hello@ondermax.com before the Cooling-Off Period expires.
6.3. If You cancel Your Order, We will reimburse all payments received from You, including the cost of standard delivery (but not any supplementary delivery costs if You chose a delivery option other than the least expensive standard delivery offered by Us).
6.4. We will make the reimbursement without undue delay and no later than:
- 14 days after the day We receive the returned Products; or
- 14 days after You provide evidence that You have sent the Products back, whichever is earlier.
6.5. You must send back the Products without undue delay and in any event no later than 14 days from the day on which You communicate Your cancellation. You shall bear the direct cost of returning the Products.
6.6. Products must be returned in their original, unopened, and unused condition. If Products have been opened, used, or are not in a resaleable condition, We may reduce the refund to reflect any diminished value.
6.7. The right of cancellation does not apply to:
- Products that have been unsealed after delivery and are not suitable for return due to health protection or hygiene reasons;
- Products made to Your specification or clearly personalised.
7. Returns and Refunds
7.1. In addition to Your statutory right of cancellation, if You receive Products that are faulty, damaged, or not as described, You are entitled to a refund, repair, or replacement under the Consumer Rights Act 2015.
7.2. To request a return, please contact Us at hello@ondermax.com with Your order number and a description of the issue.
7.3. We may request photographs or other evidence of the fault or damage before authorising a return.
7.4. Where a return is accepted due to fault or damage, We will bear the cost of return shipping.
7.5. Refunds will be processed to the original payment method within 14 days of receiving the returned Products or satisfactory evidence of return.
7.6. We reserve the right to refuse a return where the Products show signs of misuse, damage caused by the customer, or failure to follow product instructions.
8. Product Descriptions and Disclaimers
8.1. We make reasonable efforts to ensure that product descriptions, images, and information on our Website are accurate. However, minor variations in colour, packaging, or presentation may occur.
IMPORTANT NOTICE:

- Death or personal injury caused by Our negligence;
- Fraud or fraudulent misrepresentation;
- Any liability that cannot be excluded or limited under applicable law, including under the Consumer Rights Act 2015.
9.2. Subject to clause 9.1, We shall not be liable to You for any:
- Loss of profit, revenue, business, or anticipated savings;
- Loss of data or information;
- Indirect, consequential, or special loss or damage;
arising out of or in connection with any Contract between Us.
9.3. Subject to clause 9.1, Our total liability to You in respect of all losses arising under or in connection with any Contract shall not exceed the total amount paid by You for the relevant Order.
10. Intellectual Property
10.1. All content on our Website - including but not limited to text, graphics, logos, images, trademarks, and software - is the property of Ondermax LTD or its licensors and is protected by applicable intellectual property laws.
10.2. You may not reproduce, distribute, modify, or create derivative works from any content on our Website without Our prior written consent.
10.3. The Ondermax name, logo, and all related product names and designs are trademarks of Ondermax LTD. Unauthorised use is strictly prohibited.
11. Data Protection
11.1. We collect and process Your personal data in accordance with our Privacy Policy, which is available on our Website.
11.2. By placing an Order, You consent to the collection and processing of Your personal data as described in our Privacy Policy.
11.3. We comply with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Your data will be processed lawfully, fairly, and transparently.
11.4. We will not share Your personal data with third parties except as necessary to fulfil Your Order (e.g., payment processors, shipping carriers) or as required by law.
12. Governing Law and Jurisdiction
12.1. These Terms and any Contract between You and Us shall be governed by and construed in accordance with the laws of England and Wales.
12.2. Any disputes arising out of or in connection with these Terms or any Contract shall be subject to the exclusive jurisdiction of the courts of England and Wales.
12.3. If You are a consumer, You will benefit from any mandatory provisions of the law of the country in which You are resident. Nothing in these Terms affects Your rights as a consumer to rely on such mandatory provisions of local law.
13. Force Majeure
13.1. We shall not be liable for any failure or delay in performing Our obligations under any Contract where such failure or delay results from circumstances beyond Our reasonable control, including but not limited to natural disasters, epidemics, pandemics, war, terrorism, civil unrest, sanctions, government actions, trade restrictions, regulatory changes, strikes, labour disputes, supply chain disruptions, failure of telecommunications, internet or utility services, and carrier delays or shipping disruptions.
13.2. Where a Force Majeure event continues for more than 30 days, either party may terminate the Contract by written notice, and We will provide a full refund for any undelivered Products.
14. Complaints Procedure
14.1. We are committed to resolving any complaints quickly and fairly.
14.2. If You have a complaint, please contact Us at hello@ondermax.com with full details of Your concern and Your order number.
14.3. We aim to acknowledge all complaints within 2 working days and to provide a full response within 14 working days.
14.4. If You are not satisfied with Our response, You may refer the matter to an alternative dispute resolution (ADR) provider or the courts.

General
These Terms constitute the entire agreement between You and Us regarding Your use of the Website and purchase of Products. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. We reserve the right to amend these Terms at any time.
